The Top Reasons for Eviction

There’s nothing more irritating than to hear your landlord wanting to evict you from his premises. Is evicting you legal? Yes, of course, only when he has valid reasons to do so. But since eviction is a legal process, he cannot just knock at your door and off you go. There are to be laws that prohibit landlords from doing so.

If you don’t want to be evicted from your home sweet home, understand the top reasons for eviction and avoid them at all cost.

Unpaid or Late Rent

Unless the owner is running a charity work, unpaid or late payments of rental dues should be avoided at all times. If it’s inevitable, tell the owner before the due date ends; don’t wait for him to call you instead. In most cases, you will have 10 days to settle rental dues. For instance, if the due date is on the 1st day of the month, 10 days after, it’s already late. Four counts of late payments in a 12-month period can result to lease termination. On the 25th of the month, the owner can file eviction actions (unlawful detainer) if full payment is not received.

Illegal Drugs

Illegal use of drugs and paraphernalia are legal causes for instant eviction. Traces of marijuana, opium, and khat serve as a strong ground for eviction, even if you tell the authorities that your guests, not you, have had used them.

Unauthorized Guests

Friends staying under your roof for more than 15 days in a 1-year period without the consent of the landlord may be used as a valid reason for eviction. This is so rampant; in fact, this is considered as the #1 reason while people are being evicted.

Poor Housekeeping

You need to keep the inside and outside of your area neat and clean all the time. Occasionally, your landlord or property manager will inspect the premises if you are complying with this agreement. The cleanliness of your home is your sole responsibility, and untidiness is a big no-no in rental properties.

Neighborhood Disturbance

Nobody wants to wake up in the middle of the night because you’re playing loud music or chatting with your friends (on the phone!) like no tomorrow. While your home is your place of enjoyment, you also have to respect other people and keep your noise down minimum. If you got too many annoyed neighbors, they can petition for your eviction.
